Terms & Conditions
The website www.nomadchic.mx (the Site) is owned and operated by sole trader Linda Hamilton. The following sets out the terms and conditions that govern use of the Site.
Use of the Site constitutes agreement with these terms and conditions. Nomad Chic may, in its absolute discretion, modify or amend these terms and conditions from time to time and those modifications will become binding once displayed on the Site.
Nomad Chic is not liable for any loss or damages caused through the use of the Site and/or its affiliates.
By continuing to use the Site, you acknowledge and agree that Nomad Chic affiliates and Linda Hamilton are not responsible or liable for:
• Any content, including without limitation, any infringing, obscene, indecent, threatening, offensive, defamatory, tortuous, or illegal content; or
• Any third party conduct, transmissions or data, to the maximum extent per
mitted by applicable law; or
• Any viruses or other disabling features that affect your access to or use of the website.
In order to purchase items on the Site you will need to register an account. Nomad Chic may change registration requirements from time to time. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects.
Content of the Site
Nomad Chic will attempt to keep the content of the Site up to date at all times. However, Nomad Chic does not guarantee the accuracy or currency of the content. Items promoted on the Site are subject to availability and may change from time to time. By using the Site, you acknowledge that the colours of the items that are delivered to you may vary slightly from the colours displayed on the Site by your computer monitor. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Nomad Chic shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Nomad Chic shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Lisa’s Closet shall immediately issue a credit to your credit card account in the amount of the charge.
Unless otherwise stated, all prices displayed on the Site are inclusive of taxes and are shown in US dollars. The prices displayed on the Site may change at any time.
An order placed by you on the Site for an item is only an offer by you to purchase an item for the price as displayed on the Site. Nomad Chic reserves the right to accept or reject your offer for any reason whatever. Your contract with Nomad Chic will only come into existence when Nomad Chic advises you by email that it has accepted your order and confirmed receipt of your payment. If an item you have ordered is temporarily out of stock, you will be contacted by email and informed of the expected delivery date. If an item you have ordered is sold out or has been discontinued after you have placed your order, you will be contacted by email and informed.
Order Cancellations and Amendments
Nomad Chic does not guarantee that it will be able to make any changes, additions or cancellations to an order after it has accepted your order and it has confirmed receipt of your payment by email. However if an order has not been processed for delivery, changes, additions or cancellations may still be possible. Nomad Chic will confirm that a request for a change, addition or cancellation has been met by sending you an email.
Out of Stock / Back Orders
From time to time, due to unforeseen circumstances, items may be out of stock. Should this happen, you will be contacted immediately to notify you of this. Should this occur, you will be given the opportunity to cancel your order, choose an alternate product or back order your item (where possible).
Returns and Exchanges
As each collection is in limited numbers, we accept returns for store credit only. No returns accepted unless agreed to by Linda Hamilton. Exchanges for online orders will only be accepted where the product has not been worn, altered, washed and have all original tags attached. If a refund is accepted, the cost of item only (not shipping) will be refunded. Return shipping cost and taxes to be paid by customer. All exchanges must be received within 7 days of receipt of your order. Exchanges may be posted back at the customer’s expense or returned in person to our office or one of our affiliated stores. We reserve the right to refuse any returns where the products are not in new, unused condition. Products sent for return that are not in new condition can be sent back at the customer’s expense or may be picked up from our offices. We are unable to accept exchanges on sale items, special orders or any item sold at a reduced price.
The Site currently accepts payment by paypal, credit card via paypal and direct deposit.
Delivery Orders are only delivered to your nominated address between Monday to Friday during business hours. All orders will be sent to the mailing address you provide to Nomad Chic when you place an order through the Site. Most orders are sent with US Post. Furniture orders are arranged on an individual basis. Delivery within the United States generally takes 1-3 days after processing and delivery outside of the United States generally takes 4-10 days after processing. Nomad Chic will not be held accountable for late deliveries or loss or damage relating to deliveries. In the event that multiple items are ordered, part deliveries may be made where stock is not available. Postage on back order products will be at the expense of Nomad Chic. Nomad Chic will not be held responsible for incorrect delivery addresses entered into the Site.
Acceptance of Goods
All items are quality checked before shipping. The customer is responsible for inspecting the goods and notifying Nomad Chic of any faults within 5 working days of receiving the goods.
All warranties offered are those of the manufacturer and will be processed according to each products warranty guidelines.
At Nomad Chic, all items are carefully checked prior to shipping. However, if merchandise is found to be defective, please contact us to discuss your options. Any product that arrives with a fault must be returned within 7 days of receipt of your order, or we must be contacted immediately. Please note that the majority of products at Nomad Chic are handcrafted and therefore will have some irregularities. These irregularities only confirm the hand made process and should not be considered as flaws, but as an integral part of the garment that enhance its character and individuality. Any Faulty goods will be assessed as per the disclosure above and in accordance with the manufacturer’s warranty. If you have any questions about returns or faulty items please feel free to contact us.
Unless otherwise specified, all materials appearing on the Site, including the text, site design, logos, graphics, icons, images, as well as the selection, assembly and arrangement thereof are the sole property of Nomad Chic. You may use the content of this site only for the purpose of shopping on this site or placing an order on this site and for no other purpose. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without prior written permission from Nomad Chic and Linda Hamilton.
Nomad Chic respects your right to privacy. Nomad Chic takes all reasonable care when transferring and storing your details.
Collection Of Information
Nomad Chic only collects the information it needs to conduct their business. Nomad Chic may use your details to contact you regarding your order for reasons such as, but not limited to, failed credit card transactions, incomplete order information, stock availability. You will only receive marketing email if you have elected to receive them. All marketing correspondence will contain the necessary information to opt out from receiving further updates.
Storage Of Credit Card Numbers
No credit card details are stored permanently by Nomad Chic unless customer has asked us to keep on file.
Nomad Chic does not sell or provide access to your details.
Nomad Chic will disclose your details to the police or government agencies if we have sufficient reason to believe that you are using this site for illegal purposes.
Here are the extra guidelines and requirements our business will implement based on required government protocol:
~ Limited number of entry and exit points into and out of store. We will have front door open and hallway door closed.
~ Limiting the number of customers in the store.
~ Safe distancing markers inside and outside of store.
~ Signage for COVID-19 policies on front door and check out desk.
~ All deliveries and restocking will be before or after store hours.
Inside Store - Cleaning:
~ Hand sanitizer for each customer to use upon entry.
~ Disposal face masks for customers that don't have one.
~ Sales person will regularly clean key touch points with alcohol (e.g. door handles, keypads, tabletops).
~ After a customer tries on clothes, items will be hung outside on rack for 24 hours.
~ Dressing rooms will be cleaned and sanitized before and after each use.
~ Customers will be given hand sanitizer before trying on clothing.
Inside Store - Social Distancing:
~ We will inform all customers of our policies when they enter the shop.
~ We will have markings inside to facilitate compliance with the social distancing advice of 2 meters, particularly in the most crowded areas.
~ There will be clear signage throughout the store reminding customers of the social distancing measures and asking them to follow these rules.
~ Front doors will stay open to minimize the number of people who touch them.
~ We are encouraging only cashless purchases.
~ Self-checkout touch screens/keypads
– A member of our staff will be available to regularly sanitize the checkout areas, between each use.
~ Sales person rings up purchases and prepares POS to process payment.
~ Customer inserts credit card in card reader.
~ Sales person will sign "Signature on File" on iPad to complete sale.
~ Customer will remove credit card.
Inside Store - Dressing rooms, customer seating and special assistance
~ Only one customer in dressing room at a time.
~ Where customers require specialist advice/assistance in store, sales person giving the advice will have a clearly designated position.
~ Sales person will clean sunglasses, jewelry, miscellaneous items that customers try on or touch after each visit.
~ Limited customer seating in store.
Inside Store - Toilets
~ Toilets will be closed until further notice. Any suggestions or feedback is welcomed. We value your business and advice as we all become accustomed to the new norm.
